Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ProductCustomiser's platform, services, and website (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Eligibility

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

Subscription Plans and Billing

Subscription Terms

ProductCustomiser offers various subscription plans with different features and pricing. By subscribing to a plan, you agree to pay the applicable fees on a recurring basis (monthly or annually) until you cancel your subscription.

Payment

All payments are processed securely through Stripe. You authorize us to charge your payment method for all fees incurred. If your payment method fails, we may suspend or terminate your access to the Services.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.

Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial billing periods, except as required by law.

Price Changes

We reserve the right to change our pricing at any time. We will provide you with at least 30 days' notice of any price increases. Your continued use of the Services after a price change constitutes acceptance of the new pricing.

Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or networks

Feedback

If you provide us with feedback, suggestions, or ideas about the Services, you grant us the right to use such feedback without any obligation to you.

The Services may contain links to third-party websites or integrate with third-party services (such as Shopify, WooCommerce, or print-on-demand providers). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. You use the Services at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTCUSTOMISER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless ProductCustomiser and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.

Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by canceling your subscription and ceasing to use the Services. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ProductCustomiser operates, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Services shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

Miscellaneous

These Terms constitute the entire agreement between you and ProductCustomiser regarding the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. We may assign our rights and obligations under these Terms without your consent.
